Overview
This website is operated by Volcano Education. Throughout the website, the terms “we”, “us” and “our” refer to Volcano Education.
We provide this website, including its information, shop and other features, subject to your acceptance of these Terms of Service.
By visiting the website or purchasing a physical product, you agree to these terms and any other policies referred to on the website, including our Privacy Policy, Shipping Policy and Returns Policy.
The website may be used to enquire about tutoring, but tutoring sessions cannot be booked or paid for through the website. Tuition is arranged separately and is covered by a separate Tutoring Agreement.
These terms follow a similar section-based structure to the example provided, while being adapted for Volcano Education’s products and tutoring-enquiry arrangements.
Section 1 – Online store terms
By using the website or placing an order, you confirm that you are at least 18 years old or have the permission and supervision of a parent or legal guardian.
You must not use the website or any products purchased through it:

To transmit viruses, malware or harmful code

We may restrict or end access to the website where these terms are seriously or repeatedly breached.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including:

Where payment has already been taken for an order that we cannot fulfil, the relevant payment will be refunded.
You must not reproduce, copy, sell, resell or commercially exploit any part of the website, its content or our products without written permission.
Section 3 – Tuition enquiries
The website provides information about Volcano Education’s tutoring services and may allow parents and carers to submit an enquiry.
Submitting an enquiry does not:

Book or reserve a tutoring session

Guarantee availability

Create a tutoring agreement

Require us to accept a prospective student

Guarantee that we can meet a student’s particular needs
Following an enquiry, we may contact the parent or carer to discuss the student’s requirements.
Tuition is only confirmed after arrangements have been agreed separately and the parent or carer has accepted the Volcano Education Tutoring Agreement.
Section 4 – Accuracy of website information
We make reasonable efforts to ensure that the information on the website is accurate and current.
However, the website may occasionally contain:

We make reasonable efforts to display product colours, measurements, materials and images accurately. However:

Section 7 – Product availability
Products are subject to availability.
Placing an item in a basket does not reserve it. An order is not accepted until confirmation has been issued.
We may limit the quantity of products available to one customer, household, address or order where reasonably necessary.
Where an ordered product is unavailable, we may:

We will not substitute a product without the customer’s agreement.
Section 8 – Orders and customer information

Customers are responsible for checking order and address details before submitting the order.
We are not responsible for delivery problems caused by incomplete or incorrect information supplied by the customer, although we will make reasonable efforts to assist.
We may contact the customer using the email address or telephone number provided where there is a problem with an order.
Section 9 – Formation of the sales contract
Submitting an order is an offer to purchase the selected products.
An automated acknowledgement that an order has been received does not necessarily mean that the order has been accepted.
The sales contract is formed when we issue an order-acceptance or dispatch confirmation.
Online sellers must confirm the contract in a format the customer can retain, such as an email, and provide the required information about the goods and transaction.
Section 10 – Prices and payment
Prices are displayed in pounds sterling.
The total amount payable will be shown before the order is confirmed and may include:

Any optional service expressly selected by the customer
Payment must be authorised before an order is processed.
Payments may be processed by a third-party payment provider. We will not normally receive or store complete card details.
We may cancel an order where a payment is declined, reversed or suspected to be fraudulent.
Section 11 – Delivery
Available delivery options, charges and estimated times will be shown at checkout or in the Shipping Policy.
Unless another period has been agreed, goods purchased online should normally be delivered within 30 days.
Delivery dates are estimates unless expressly confirmed as guaranteed.
Customers must provide a safe and accurate delivery address. Where a parcel is returned because an address was incorrect or delivery was repeatedly refused, additional postage may be required before it is resent.
Responsibility for the goods normally passes to the customer when they, or a person nominated by them, receive the products.
Section 12 – Changing your mind
Customers purchasing most physical goods online normally have the right to cancel the order within 14 days after receiving the goods.
Where one order contains multiple goods delivered on different days, the cancellation period normally runs from the day after the final item is received.
To cancel, the customer must send a clear statement explaining that they wish to cancel the purchase.
After notifying us, the customer must normally return the goods within a further 14 days.
The customer may be responsible for return postage where this was explained before purchase and the goods are not faulty or incorrectly supplied.
Section 13 – Exceptions to change-of-mind cancellation
The right to cancel may not apply to:

Personalised products

Products made to the customer’s specification

Bespoke or commissioned items

Goods that deteriorate or expire quickly

Sealed hygiene-sensitive goods after the seal has been broken

Other goods excluded under applicable consumer law
Any relevant restriction will be made clear on the product page before the order is submitted.
This restriction only applies where the customer changes their mind. It does not remove their rights if a product is faulty, damaged, unsafe or not as described.
Section 14 – Returns
Returned products should be:

Accompanied by information identifying the order

Returned without unnecessary handling or damage
Customers may inspect goods as they reasonably would in a physical shop. A refund may be reduced where the customer has handled the goods beyond what was reasonably necessary and this has reduced their value.
The customer should retain proof of postage until the return has been completed.

Section 15 – Refunds
For an eligible change-of-mind cancellation, we will refund:

The price paid for the returned goods

The cost of the least expensive standard delivery method originally offered, where applicable
Any additional amount paid for express or premium delivery does not normally have to be refunded beyond the cost of standard delivery.
A refund will normally be processed within 14 days after we receive the returned goods or receive acceptable evidence that they have been sent back.
Refunds will usually be issued through the original payment method.
Section 16 – Faulty, damaged or incorrect products
Customers should contact us promptly where a product:

Customers have statutory rights relating to faulty goods. Goods must be of satisfactory quality, fit for purpose and as described.

We may ask for reasonable information or photographs to help assess damage or identify the product, but this will not reduce the customer’s statutory rights.

Nothing in these terms requires a consumer to compensate Volcano Education in a way that would be unfair or contrary to UK consumer law.
A business or commercial user may be responsible for reasonable losses caused by its unlawful use of the website, infringement of intellectual-property rights or deliberate breach of these terms.
Section 26 – Severability
If any section of these terms is found to be unlawful or unenforceable, that part will be treated as removed or limited to the minimum extent necessary.
The remaining sections will continue to apply.
Section 27 – Termination
These website terms continue while a person uses the website.
A visitor may stop being bound by the website-use provisions by ceasing to use the website. Any obligations arising from an existing product order, payment, return, complaint or intellectual-property matter will continue where necessary.
We may restrict a person’s access to the website where they seriously or repeatedly breach these terms.
Section 28 – Entire agreement
These terms, together with the policies referred to on the website, form the agreement governing use of the website and online purchases.
Separate tuition arrangements remain governed by the Volcano Education Tutoring Agreement and related tutoring policies.
Section 29 – Governing law
These terms are governed by the laws of England and Wales.
Nothing in this section removes any mandatory rights available to consumers elsewhere in the United Kingdom.
Section 30 – Changes to these terms
We may update these terms to reflect:
